PRIORITY DIRECTIONS OF IMPROVEMENT OF THE INSTITUTE OF EXEMPTION FROM CRIMINAL RESPONSIBILITY: THEORY AND PRACTICE

Abstract

 In this article, the theoretical and legal foundations of the institution of exemption from criminal responsibility, which is considered an important component of the policy of liberalization of criminal law in the Republic of Uzbekistan, the current normative legal regulation and the practice of its application are comprehensively analyzed. During the research, the essence, functions and role of the institution of exemption from criminal liability in the system of criminal law were evaluated from the point of view of modern criminal policy. Also, relevant norms of the Criminal Code of the Republic of Uzbekistan, judicial investigation practice and the experience of foreign countries were studied from a comparative legal point of view. In the study, the effectiveness of the institute was determined based on statistical data and practical examples, and existing problems were analyzed. The results showed the existence of normative uncertainties, terminological inconsistencies and some legal gaps in the application of the institution of exemption from criminal liability. On this basis, scientific-practical proposals aimed at improving the legislation, unifying judicial practice and widely introducing the principles of restorative justice were developed. The results of the research serve to develop the processes of further humanization and liberalization of criminal legislation.
